Pujadevi Kameshwar Sinhunder various credit facilities aggregating to Rs.16,36,700/- (Sixteen Lacs Thiry Six Thousand Seven HundredOnly)as more particularly described in Schedule I hereunder. I/we had called on your office on ________ and deposited with you title deeds of property belonging to us (The title deeds are more particularly described in Schedule III signed by me/us and attached herewith) with an intention to create charge by way of equitable mortgage of the properties (The properties are better detailed in Schedule II signed by me/us and attached herewith) so as to enable you to secure the amount due under aforesaid various credit facilities granted to1. Kameshwarsinh Ramdev Sinh&2. Pujadevi Kameshwar SinhVide sanction letter No-AP-10282299 dated-06/06/2024 AmounttotoRs.16,36,700/- ( Sixteen Lacs Thiry Six Thousand Seven Hundred Only).
I/We have given you oral consent to retain and hold the aforesaid title deeds and documents, deposited with an intent to create equitable mortgage by way of first charge over the said properties for the total credit facilities of toRs.16,36,700/- ( Sixteen Lacs Thiry Six Thousand Seven Hundred Only)As more particularly described in Schedule I hereunder) granted to1. Kameshwarsinh Ramdev Sinh&2. Pujadevi Kameshwar Sinh together with interest, commission, cost charges, expenses and any other money b1. Kameshwarsinh Ramdev Sinh&2. Pujadevi Kameshwar Sinhto you and all costs (as between attorney and client), charges, expenses paid as incurred by you in the protection, preservation, enforcement, realization of such securities and recovery of its dues and a certain of rights under such security that the said security will be and always remain a continuing securityI/We further assure, declare and confirm that the title deeds so deposited are the only title deeds relating to the said immovable properties belonging to me/us which are mortgaged by deposit of title deeds to you and I/ we have marketable title to the said properties and there is no subsisting mortgage, charge, lien or other encumbrance in favour of any government or income tax department or any other person, firm, company or incorporated body or society whatsoever and I/we have not entered into any agreement for sale thereof or any part thereof any person, firm or other incorporated body or society or entity.I/We further assured you that I/we shall not create any further mortgage, charge, lien or encumbrance and shall not permit any attachment to be levied on the said flats or any part or part thereof in favour of any government or income tax department or any person, firm, company or other incorporated body or society or entity as long as we continues to be indebted or liable to the Bank on any account or in any manner whatsoever and that no proceedings for recovery of any tax dues are pending with us either under income tax act or any other law and that no notice have been issued and/or served upon me/us under the income tax act or any other law and that there is no pending attachment or injunction whatsoever levied howsoever on the said immovable properties.
